Google Drive scores multiple photo and video uploads on iOS, Wallet gets visual refresh on Android

Mountain View's just doled out an update to Google Drive on iOS, giving it the ever so slight bump to version 1.2.2 and a handful of new features. Font fanatics could see the addition of Helvetica Neue to Docs as the big ticket item in the new release, but the ability to upload multiple photos and videos otherwise headlines the batch of improvements. With the latest version, pinch to zoom now works with slides and QuickOffice users can open files and save them to Drive. In addition, spreadsheets have been freshly endowed with improvements to animations, diagonal scrolling and cell formatting for dates, decimals, currency and the like. Google Wallet on Android also received an update, but it focused on delivering a revamped UI and sundry improvements to stability and battery use. Now, the app packs navigation tabs and houses cards under the "My Wallet" section. Hit the neighboring source links to give either application a spin.

(AP) ? A fast-moving fire roared through a crowded nightclub in southern Brazil early Sunday, within seconds filling the space with flames and a thick, toxic smoke that killed more than 230 panicked partygoers who gasped for breath and fought in a stampede to escape.

It appeared to be the world's deadliest nightclub fire in more than a decade.

Firefighters responding to the blaze at first had trouble getting inside the Kiss nightclub because bodies partially blocked the club's entryway.

Witnesses said a flare or firework lit by band members started the blaze in Santa Maria, a university city of about 260,000 people. Officials at a news conference said the cause was still under investigation ? though police inspector Sandro Meinerz told the Agencia Estado news agency the band was to blame for a pyrotechnics show and that manslaughter charges could be filed.

Television images showed black smoke billowing out of the Kiss nightclub as shirtless young men who had attended a university party joined firefighters using axes and sledgehammers to pound at windows and hot-pink exterior walls to free those trapped inside.

Bodies of the dead and injured were strewn in the street and panicked screams filled the air as medics tried to help. There was little to be done; officials said most of those who died were suffocated by smoke within minutes.

Within hours a community gym was a horror scene, with body after body lined up on the floor, partially covered with black plastic as family members identified kin.

Outside the gym police held up personal objects ? a black purse, a blue high-heeled shoe ? as people seeking information on loved ones looked crowded around, hoping not to recognize anything being shown them.

Guido Pedroso Melo, commander of the city's fire department, told the O Globo newspaper that firefighters had a hard time getting inside the club because "there was a barrier of bodies blocking the entrance."

Teenagers sprinted from the scene after the fire began, desperately seeking help. Others carried injured and burned friends away in their arms. Many of the victims were under 20 years old, including some minors.

"There was so much smoke and fire, it was complete panic, and it took a long time for people to get out, there were so many dead," survivor Luana Santos Silva told the Globo TV network.

The fire spread so fast inside the packed club that firefighters and ambulances could do little to stop it, Silva said.

Another survivor, Michele Pereira, told the Folha de S. Paulo newspaper that she was near the stage when members of the band lit flares that started the conflagration.

"The band that was onstage began to use flares and, suddenly, they stopped the show and pointed them upward," she said. "At that point, the ceiling caught fire. It was really weak, but in a matter of seconds it spread."

Guitarist Rodrigo Martins told Radio Gaucha that the band, Gurizada Fandangueira, started playing at 2:15 a.m. "and we had played around five songs when I looked up and noticed the roof was burning"

"It might have happened because of the Sputnik, the machine we use to create a luminous effect with sparks. It's harmless, we never had any trouble with it.

"When the fire started, a guard passed us a fire extinguisher, the singer tried to use it but it wasn't working"

He confirmed that accordion player Danilo Jacques, 28, died, while the five other members made it out safely.

Police Maj. Cleberson Braida Bastianello said by telephone that the toll had risen to 233 with the death of a hospitalized victim. He said earlier that the death toll was likely made worse because the nightclub appeared to have just one exit through which patrons could exit.

Survivors said security guards briefly tried to block people from exiting the club. Brazilian bars routinely make patrons pay their entire tab at the end of the night before they are allowed to leave.

Officials earlier counted 232 bodies that had been brought for identification to a gymnasium in Santa Maria, which is located at the southern tip of Brazil, near the borders with Argentina and Uruguay.

Federal Health Minister Alexandre Padhilha told a news conference that most of the 117 people treated in hospitals had been poisoned by gases they breathed during the fire. Only a few suffered serious burns, he said.

Brazil President Dilma Rousseff arrived to visit the injured after cutting short her trip to a Latin American-European summit in Chile.

"It is a tragedy for all of us," Rousseff said.

Most of the dead apparently were asphyxiated, according to Dr. Paulo Afonso Beltrame, a professor at the medical school of the Federal University of Santa Maria who went to the city's Caridade Hospital to help victims.

Beltrame said he was told the club had been filled far beyond its capacity during a party for students at the university's agronomy department.

Survivors, police and firefighters gave the same account of a band member setting the ceiling's soundproofing ablaze, he said.

"Large amounts of toxic smoke quickly filled the room, and I would say that at least 90 percent of the victims died of asphyxiation," Beltrame told The Associated Press by telephone.

"The toxic smoke made people lose their sense of direction so they were unable to find their way to the exit. At least 50 bodies were found inside a bathroom. Apparently they confused the bathroom door with the exit door."

In the hospital, the doctor "saw desperate friends and relatives walking and running down the corridors looking for information," he said, calling it "one of the saddest scenes I have ever witnessed."

Rodrigo Moura, identified by the newspaper Diario de Santa Maria as a security guard at the club, said it was at its maximum capacity of between 1,000 and 2,000, and partygoers were pushing and shoving to escape.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309.

In 2004, at least 194 people died in a fire at an overcrowded nightclub in Buenos Aires, Argentina. Seven members of a band were sentenced to prison for starting the flames.

A blaze at the Lame Horse nightclub in Perm, Russia, killed 152 people in December 2009 after an indoor fireworks display ignited a plastic ceiling decorated with branches.

Similar circumstances led to a 2003 nightclub fire that killed 100 people in the United States. Pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling of a Rhode Island music venue.

The band performing in Santa Maria, Gurizada Fandangueira, plays a driving mixture of local Brazilian country music styles. Guitarist Martin told Radio Gaucha the musicians are already seeing hostile messages.

"People on the social networks are saying we have to pay for what happened," he said. "I'm afraid there could be retaliation".

'Fruitvale,' 'Blood Brother' win Sundance Awards

PARK CITY, Utah (AP) ? The dramatic film "Fruitvale" and the documentary "Blood Brother" won over audiences and Sundance Film Festival judges.

Both American films won audience awards and grand jury prizes Saturday at the Sundance Awards.

"Fruitvale" is based on the true story of Oscar Grant, who was 22 years old when he was shot and killed in a public transit station in Oakland, Calif. First-time filmmaker Ryan Coogler wrote and directed the dramatic narrative.

"This project was about humanity, about human beings and how we treat each other; how we treat the people that we love the most, and how we treat the people that we don't know," the 26-year-old said as he accepted the final prize of the night. "To get this award means that it had a profound impact on the audience that saw it, on the people that were responsible for picking it up. And this goes back to my home, to the Bay Area, where Oscar Grant lived, breathed, slept, loved, fought, had fun, and survived for 22 years."

Fox Searchlight founder and Sundance juror Tom Rothman said "Fruitvale" was recognized for "its skillful realization, its devastating emotional impact and its moral and social urgency ? and for anyone out there who thinks for one second that movies don't matter and can't make a difference in the world.

"This will not be the last time you guys walk to a podium," he added.

Coogler said he felt personally connected to the story because he's from Oakland and was born the same year as the subject of his film.

"So I'm the same age, same demographic. So when I saw the footage, initially I was heartbroken, frustrated, and the biggest thing was that Oscar looked like us, you know what I mean?" he said. "He looked like any one of my friends ? could have been me, could have been them, and these situations happen again and again."

The U.S. documentary winner, "Blood Brother" follows a young American, Rocky Braat, who moved to India to work with orphans infected with HIV.

"This means so much to so many kids," director Steve Hoover said as he accepted the award.

Other dramatic winners at the ceremony hosted by actor-director Joseph Gordon-Levitt included Lake Bell, who accepted the Waldo Salt Screenwriting Award for her directorial debut, "In A World," and Jill Soloway, who won the directing award for her feature debut, "Afternoon Delight."

Soloway thanked Bell and the other "lady directors" making their debuts at the festival.

"I feel like we all crossed the street together holding hands," she said. "We're all out there together exposing ourselves and I love being here with you guys."

Cinematographer Bradford Young was recognized for his work in two dramatic films, "Ain't Them Bodies Saints" and "Mother of George."

Documentary winners included Zachary Heinzerling for directing "Cutie and the Boxer" and Matthew Hamachek for editing "Gideon's Army."

The Cambodian film "A River Changes Course" won the grand jury prize for international documentary, and a narrative film from South Korea, "Jiseul," claimed the grand jury prize for dramatic world cinema.

Having a film at Sundance serves as a stamp of approval, Coogler said.

"Audiences trust this film festival more than any other festival in the country," he said, "and they know if a film plays here, it's a film that should be seen."

    Fire researchers from the National Institute of Standards and Technology (NIST) and colleagues from fire service organizations will turn abandoned wood-frame, single-family houses near the site of an old Spartanburg, S.C., textile mill into proving and training grounds for new science-driven fire-fighting techniques this week. The objective of the study is to improve firefighter safety and effectiveness.

    Experiments conducted in eight different houses will demonstrate fire-fighting methodsindividually and in combinationsfor strategically ventilating and isolating fires to preventor at least delayflashover, the extremely perilous phenomenon that occurs when heat builds up in a burning structure's contents and components to the point that they burst into flames simultaneously.

    In conjunction with the experiments, the International Society of Fire Service Instructors (IFSI) will videotape how firefighters implement size-up, flowpath control, and exterior fire attack, also known as transitional attack. The IFSI will then develop training modules that will be available to firefighters across the country.

    Other collaborators in the field experiments include the International Society of Fire Service Instructors, the South Carolina Fire Academy, the Spartanburg Fire Department, the South Carolina State Fire Marshal's Office and the Spartanburg Public Safety Office. The project is funded with a DHS/FEMA Assistance to Firefighters Grant.

    In July 2012, in another team effort, NIST fire researchers gathered data in experimental burns in 20 abandoned townhouses on New York's Governors Island, about a kilometer from the southern tip of Manhattan.

    The Spartanburg fire tests are being conducted in an area slated for a major redevelopment initiative.

    Panetta to Announce End of Direct Combat Exclusion for Women

    Speaking anonymously, a senior defense official said on Wednesday that the Pentagon would be lifting the rule against women being assigned to direct combat roles. Secretary of Defense Leon Panetta and Joint Chiefs chairman Gen. Martin Dempsey will make the official announcement. The policy change will allow the military services to begin planning their implementation of the decision. Modern warfare has brought more women than ever to the front lines, where there were front lines, and into combat.

    Heroes

    Many women have been recognized for their bravery in combat. Here are just a few. Army helicopter pilot Rhonda Cornum was captured by Iraqi forces in 1991 and held for two weeks. Kim Campbell was awarded the Distinguished Flying Cross for her piloting of a severely damaged A-10 over Iraq in 2003. The Silver Star is the nation's third highest medal for valor in battle. Two women were awarded this honor in the last decade, a first for a woman since World War II. Leigh Ann Hester received a Silver Star for her heroic actions during an ambush in Iraq in 2005 that killed 27 enemy fighters. In an Afghan fight in 2007, Monica Lin Brown received a Silver Star for her bravery as a combat medic while treating wounded under fire.

    Killed in Action

    Hundreds of American military personnel who are women have been killed or wounded since 2001. Here is a small sample of those losses. In 2006, Amanda Pinson was waiting for a bus on a U.S. base in Iraq when she was killed by mortar fire. Jennifer Parcell served with the Marine Lioness program in Iraq and was killed by a female suicide bomber in 2007. Rachael Hugo was killed in an convoy ambush in Iraq in 2007. Jessica Sarandrea was killed in a mortar attack on a U.S. base in Iraq in 2009. Devin Snyder was killed in 2011 when her vehicle hit a mine in Afghanistan.

    Reactions

    Arizona Sen. John McCain, a career Navy officer and former POW, has this to say about the decision to open direct combat roles to women: "I respect and support Secretary Panetta's decision to lift the ban on women serving in combat. The fact is that American women are already serving in harm's way today all over the world and in every branch of our armed forces. Many have made the ultimate sacrifice, and our nation owes them a deep debt of gratitude."

    Illinois Rep. Tammy Duckworth, herself a combat veteran who was badly wounded when her helicopter was struck by enemy fire, also applauded the decision. "This decision to allow women to serve in combat will allow the best man or woman on the frontline to keep America safe. ... As a veteran who saw combat action I know the inclusion of women in combat roles will make America safer and provide inspiration to women throughout our country."

    U.N. urges Syria's neighbors to keep open borders to exodus

    GENEVA (Reuters) - The United Nations on Friday urged Syria's neighbors to keep open their borders to civilians fleeing the intensifying conflict and said that the refugee exodus into Jordan was "absolutely dramatic".

    More than 30,000 Syrians have arrived in Jordan's main Zaatri camp this year, including 4,400 on Thursday and another 2,000 overnight, it said. Most were fleeing fighting in the southern area of Deraa, food and fuel shortages and high prices.

    Turkey has said that camps are filling up as soon as they are built and officials in Jordan said this week it would keep its borders open but wanted other countries to help it boost its ability to cope with the influx.

    "It is just absolutely dramatic the inflow of people that continues into Jordan," Melissa Fleming, chief spokeswoman of the U.N. High Commissioner for Refugees (UNHCR), told a news briefing in Geneva.

    Jordan now hosts more than 206,000 Syrians who have registered as refugees or await processing, while the government says that more than 300,000 Syrians are actually in the country.

    A further 30,000 Syrians could be preparing to head to Jordan, according to the UNHCR's latest assessment.

    Across the region, 678,540 Syrian refugees had registered or were being processed as of Tuesday, according to UNHCR figures for Jordan, Turkey, Lebanon, Iraq and North Africa.

    "It is fast approaching 700,000," spokeswoman Sybella Wilkes told Reuters. "It is a challenge on every border the number of people that are arriving and crossing borders every day."

    Fleming said the UNHCR commended the Jordanian, Lebanese and Turkish governments for keeping their borders open and urged them to continue to do so.

    Refugees report fighting in Deraa and its suburbs but the UNHCR was not in a position to assess military activities, she said. Water and electricity are only available for intermittent periods in parts of southern Syria.

    Some 25,000 to 40,000 Syrians are reported to be massed in northern Syria along Turkey's border, awaiting entry into the country which has 15 refugee camps and is building a further five, Fleming said.

    "They are building camps as fast as they can and they are letting people in as soon as the camps are ready," she said.

    What began as a mostly peaceful movement against President Bashar al-Assad has killed more than 60,000 people in 22 months, devastated the economy and left 2.5 million people inside the country hungry, according to the U.N.

    Ted Chaiban, UNICEF director of emergency programs who was in Syria last week, said food, basic medicines and drinkable water were getting harder to find, while families were living 20 to a room with minimal shelter and clothing in cold weather.

    US jobless claims drop to 5-year low of 330,000

    (AP) ? The number of Americans seeking unemployment aid fell last week to the lowest level in five years, evidence that employers are cutting fewer jobs and may step up hiring.

    The Labor Department said Thursday that weekly unemployment benefit applications dropped 5,000 to a seasonally adjusted 330,000. That's the fewest since January 2008.

    The four-week average, a less volatile measure, fell to 351,750. That's also the lowest in nearly five years.

    The decline may reflect the government's difficulty adjusting its numbers to account for layoffs after the holiday shopping season. Layoffs spike in the second week of January and then plummet. The department seeks to adjust for those seasonal trends, but the figures can still be volatile.

    If the trend holds up, fewer applications would suggest the job market is improving.

    "Encouraging news on the U.S. jobs front, even when you remove all of the noise," said Jennifer Lee, an economist at BMO Capital Markets. "Weekly data are noisy, particularly at this time of year, so keep that in mind."

    Applications are a proxy for layoffs. They have fluctuated between 360,000 and 390,000 for most of last year. At the same time, employers added an average of 153,000 jobs a month. That's just been enough to slowly push down the unemployment rate, which fell 0.7 percentage points last year to 7.8 percent.

    There have been other positive signs for the economy and job market.

    The once-battered housing sector is recovering, which is boosting construction and home prices. Home builders started work in 2012 on the most new homes in four years. And sales of previously occupied homes reached their highest level in five years last year. Still, home building and sales remain below the levels consistent with a healthy economy.

    More home building will likely increase job growth. In December, the economy gained 30,000 construction jobs ? the most in 15 months. And economists expect construction firms to add more jobs this year as the housing recovery strengthens.

    Patrick Newport, an economist at IHS Global Insight, forecasts that construction companies will add 140,000 jobs this year, up from a meager 18,000 in 2012.

    The number of people continuing to claim benefits is also falling. There were nearly 5.7 million people receiving unemployment aid in the week ended Jan. 5, the latest data available. That's down from almost 5.9 million in the previous week.

    The overall economy grew at an annual rate of 3.1 percent in the July-September quarter. But economists believe activity slowed considerably in the October-December quarter to a rate below 2 percent or less, in part because companies cut back on restocking.

    Less restocking leads to slower factory production, which weighs on economic growth.

    Ohio rape trial of football players should be closed: prosecutor

    (Reuters) - The trial of two Ohio high school football players charged with raping a 16-year-old girl should be closed to the public to protect the accuser in a case that has received national attention, the state's attorney general said on Thursday.

    The case caused a national sensation earlier this month when the hacker activist group Anonymous publicized a picture of two young men carrying the girl by her wrists and ankles and released a video showing other young men joking about the alleged assault.

    A defense attorney has also requested that the trial be closed. Both the office of Ohio Attorney General Mike DeWine and the defense have said that the accuser has also made the request.

    A hearing on the motions before visiting Hamilton County Judge Tom Lipps is set for Friday in Jefferson County Common Pleas Court. In Ohio, it is easier to close juvenile hearings than adult trials.

    Ma'Lik Richmond and Trent Mays, both 16, are to face trial as juveniles next month in Steubenville, a city of 19,000 near the Pennsylvania border. Prosecutors say the two members of the high school football team there had raped a classmate at a party attended by many teammates last August.

    Community leaders have criticized authorities, voicing suspicion they have avoided charging more players who could have been involved in order to protect the school's beloved football program.

    Reuters is not identifying the accuser because she is a purported victim of sexual assault.

    In his filing last week, Richmond's lawyer, Walter Madison, said closing the trial to the public would be the only way to protect witnesses from Anonymous, which has threatened to expose private information of anyone who helps protect his client from prosecution.

    Also on Thursday, students from Ohio State University delivered a petition with 70,000 signatures to DeWine's office, demanding that everyone present at the party be charged to the fullest extent of the law.

    DeWine met with three of the students in his office, where they discussed the judicial process, spokesman Dan Tierney told Reuters.

    Days before testifying against Richmond and Mays, at least three teammates who attended the party received commitments from prosecutors that they would not be prosecuted for any crimes, according to documents Reuters received from a source directly involved in the case.

    In letters from DeWine's office addressed to each student's lawyer, the state committed to not prosecuting Evan Westlake, Anthony Craig and Mark Cole, three witnesses for the prosecution.

    But DeWine has said that his office had made no deal with any of the witnesses involved in the case. The office has said the investigation is continuing, and that a lack of evidence has prevented prosecutors from bringing more charges.

    The event in Australia broke more records than you could possible shake a stick at. Go here [climatecentral.org] for just the briefest scientific review of the incident. Here's a quote: "A relatively small change in the average temperature can easily double the frequency of extreme heat events. Australia has warmed steadily since the 1940s, and the probability of extreme heat has now increased almost five-fold compared with 50 years ago." What part of this do you not get. Globally, spring comes 3 weeks earlier than 50 years ago. The clear and unmistakable results of climate change measure in the ten of thousands of unique individual events and phenomena. Taken as a body of evidence you'd have a better chance of arguing against evolution (and the body of evidence doesn't stop ideologues from doing that either.) Why is it that I'm yelling "Hey, dummy your arse is burning!" and instead of putting it out and thanking me for saving your life, you choose instead get insulting and indignant.

    I'm point at trends, when data point after data point in one direction you get a trend. The system is incredibly complex, melting in the arctic messes with the haline cycle (and recent changes in the Gulf Stream suggest global current changes may be imminent.) These changes would have profound effects on global climate particularly cutting warm currents to the extreme latitudes causing dramatically colder winters. So there are a number of possible outcomes, when you perturb a system as complex as global weather, it's like throwing dice, many possible things can happen because there are many competing feedback loops and we still can't produce predictive models with the subtlety to give us long term predictions of complex chaotic systems.

    That said, we can look at more general possibilities and compare them against what has already happened, in other words if I create a model starting in 1850 and successfully predict general large scale climate features and event up until now, I have a reasonable probability of predicting some of the large scale events coming. As for pulling out a single anything, that's crap no single data point informs you of anything. Again, the only thing that matters are trends, and we have those, we have a whole bunch of trends.

    And I wish for the love of Jebus you guys could have one of these conversation without blowing all kinds personal FUD, you can stick your presumptions where the sun don't shine. You haven't the foggiest idea what my political opinions are but its clear that if your as good at guessing politics as you are about noticing its getting hotter every year that it explains why you can't seem to make a cogent observation about physical reality. In the flagellating department I believe its better to give than to receive. Guilt is what nice people do to assuage their consciences for being irresponsible or committing unkind acts. I don't practice either, therefore no guilt. I never said the world was ending, not today or a week from Tuesday or in a thousand years. Humanity is extincting about a 1000 species a day now. Most are insects and various invertebrates. Still, in your and my lifetime, we'll see the last of all the big mammals in Africa, most in Asia, and nearly half of the world's rain forest will go away. The impact of the change we're perpetrating on the environment will come back to haunt us because our biology is intimately tied to the global biology... nature of ecosystems. Every human being is a river of biota, moving through us every moment are ten times as many cells without a human genome as with. Plow the ecosphere under and we're committing slow motion suicide. Life has ben here nearly 4 billion years and suffered far worse than us, it will get along fine without us. We're an apex predator, we'll be one of the first things to go. Or, we'll pull our collective heads out of our rear ends and design a global technology that supports human advance without turning the world into a toilet. Why is that

    Thailand?s draconian l?se majest? law continues to curb freedom of expression and has arguably reached a new level of arbitrariness with the most recent sentencing:

    A Thai court has sentenced a leader of the Red Shirt political movement to two years in prison for a speech judged to have insulted the country?s monarchy.

    The court ruled Thursday that 54-year-old Yoswarit Chuklom made a speech insulting the monarchy at a political rally in 2010. The Red Shirts took to the streets in 2010 in political protests that ended with deadly clashes with the military.

    A Thai court today sentenced a government adviser, who helped lead protests in 2010 against former Prime Minister?Abhisit Vejjajiva, to two years in prison for insulting the royal family.

    Yossawaris Chuklom, a comedian who goes by the name Jeng Dokjik, received the sentence for comments made in a speech to protesters that implied King Bhumibol Adulyadej influenced Abhisit?s decision not to dissolve the parliament, according to a court statement. The court said it freed him on bail while he appeals the sentence because he showed no intention to flee.

    While Yossawaris can not be considered as one of the highest-ranking red shirt leaders ? of which there were many during the 2010 protests ? his sentencing still needs special attention.

    In sentencing a former protest leader to two years in prison, a court ruled that the defendant was liable not only for what he said, but also for what he left unsaid.

    The criminal court?s ruling said the defendant, Yossawarit Chuklom, had not specifically mentioned the king when he gave a speech in 2010 to a large group of people protesting the military-backed government then in power.?But by making a gesture of being muzzled ? placing his hands over his mouth ? Mr. Yossawarit had insinuated that he was talking about the king, the court ruled.??Even though the defendant did not identify His Majesty the king directly,? the court ruled, Mr. Yossawarit?s speech ?cannot be interpreted any other way.?

    The court ruled that it was obvious whom Mr. Yossawarit was talking about. During the trial, Thais with no apparent connection to the case were called to the stand and asked to whom they thought he was referring. All of the witnesses said, ?The king.?

    This is indeed a new dimension of how arbitrarily l?se majest? is being applied here, on top of an already ambiguously written law (?insulting, defaming or threatening?): As many other l?se majest? (e.g. Ampon?s) or similar cases (e.g. Chiranuch?s) have shown, the principle is actually ?in dubio contra reo? (?when in doubt, decide against the accused?) for many different reasons.?Since the presumption of innocence doesn?t apply here, the prosecution is mostly not interested in the actual evidence (or the lack of in some cases), but rather in the ?intent? of the alleged crime.

    David Streckfuss, a Khon Kaen-based academic and expert on the l?se majest? law, wrote in an academic article in 1995 ? long before the recent surge of cases ? about the rationale of these cases, since ?the truth or accuracy of the defendant?s words is irrelevant to the case. The defendant?s intent is determined by its hypothetical effect? (p. 452). Taking the case of then-Democrat Party secretary general (and later Thai Rak Thai executive and even later red shirt leader) Veera Musikapong?from the 1980s, Streckfuss has deduced ?five ?principles? that highlight the absurd mechanics of this draconian law ? here?s an excerpt:

    The First Principle: Truth and Intent are Subordinated to Presumed Effect

    Truth or guilt is determined purely by its effect. In a regular slander case, the central issue is substantiating the truth ? that is, a statement of truth that sullies someone?s reputation is not slander. If the defense can prove what the defendant said was true, the plaintiff?s case is lost, even if that truth has stained his or her character. In lese-majeste cases, however, it is not necessary to substantiate the truth, for the truth of what was said is not at issue. Ascertaining guilt remains at the level of its hypothetical impact, determined by the projected effect the words, if believed to be true, would have on listeners. [...]

    The Second Principle: Actual Proof of Lese-Majeste?Requires Further Violation of Royal Dignity

    ?[G]uilt is determined by what the court estimates a safely abstract (and unascertainable) ?people? would feel were they to hear the words and believe them to be true. As a result, the prosecutors have the contradictory task of trying to argue how inflammatory the slanderous remarks are ? that they indeed constitute a threat to the security of the state and would cause people to look down on the king or the monarchy ? while at the same time maintaining that the words have no such effect on them personally. [...] If a witness for the prosecution, say, admitted that the intended effect of the words ? to cause the king to be looked upon negatively ? had succeeded in his or her own personal case, this would indeed be a confession, under oath, of l?se-majest?.?

    As of now, Yossawaris has appealed his sentencing. Meanwhile on Wednesday, the criminal court is expected to read their verdict against veteran labor activist Somyot Prueksakasemsuk, who is charged for editing articles in a news magazine that were deemed insulting to the monarchy.?L?se majest? continues to make headlines in 2013 and ?those defending it still find it hard to realize that with each case?

    ?The end result is that the dynamic?of this law do more damage to the monarchy than its critics could ever hope.?

    Chefs Ball At Art And Soul Celebrates Inauguration (PHOTOS)

    WASHINGTON -- Chef, restauranteur and television star Art Smith preached a simple message at the Chefs Ball. "When you are cooking for people, there are no angry people, just hungry people."

    Based on the ravenous crowd of 500, there appeared to be no angry people at Art and Soul on Saturday night.

    Smith spoke to the crowd about the role the D.C. food community plays in the community. "What we're doing has nothing to do with politics. Food is peace. We can create change through food."

    "Modern Family's" Jesse Tyler Ferguson, ?Top Chef All-Stars? finalist and Graffiato chef Mike Isabella and Illinois Gov. Pat Quinn (D) made appearances.

    Former president Spanier attends Penn State game

    STATE COLLEGE, Pa. (AP) ? Former Penn State President Graham Spanier attended the school's men's basketball game against Nebraska on Saturday, making a rare high-profile appearance on campus in the aftermath of the Jerry Sandusky child molestation scandal.

    Spanier and two other high-ranking former administrators face charges including perjury and obstruction for allegedly covering up sex abuse allegations against Sandusky, a retired assistant football coach. All three are awaiting a preliminary hearing and have maintained their innocence.

    Spanier left under pressure days after Sandusky's November 2011 arrest, while Hall of Fame coach Joe Paterno was fired. A university-sanctioned investigation by former FBI director Louis Freeh accused Spanier and Paterno of participating in a cover-up to protect the school's image.

    Paterno died almost a year ago. His family has firmly denied the allegations of a cover-up.

    Light switch inside brain: Laser controls individual nerve cells in mouse

    Jan. 18, 2013 ? Activating and deactivating individual nerve cells in the brain is something many neuroscientists wish they could do, as it would help them to better understand how the brain works.

    Scientists in Freiburg and Basel, Switzerland, have developed an implant that is able to genetically modify specific nerve cells, control them with light stimuli, and measure their electrical activity all at the same time. This novel 3-in-1 tool paves the way for completely new experiments in neurobiology, also at Freiburg's new Cluster of Excellence BrainLinks-BrainTools.

    Birthe Rubehn and her colleagues from the Department of Microsystems Engineering (IMTEK) and the Bernstein Center of the University of Freiburg as well as the Friedrich Miescher Institute for Biomedical Research in Basel describe the prototype of their implant in the journal Lab on a Chip. They report that initial experiments in which they implanted prototypes into mice were successful: The team was able to influence the activity of nerve cells in the brain in a controlled manner by means of laser light pulses.

    The team used an innovative genetic technique that makes nerve cells change their activity by shining different colored lights on them. In optogenetics, genes from certain species of algae are inserted into the genome of another organism, for instance a mouse. The genes lead to the inclusion of light-sensitive pores for electrically charged particles into a nerve cell's membrane. These additional openings allow neuroscientists to control the cells' electrical activity.

    However, only the new implant from Freiburg and Basel makes this principle actually practicable. The device, at its tip only a quarter of a millimeter wide and a tenth of a millimeter thick, was constructed on the basis of polymers, special plastics whose safety for implantation into the nervous system has been proven.

    Unlike probes developed so far, it is capable of injecting substances necessary for genetic modification, emitting light for the stimulation of the nerve cells, and measuring the effect through various electrical contacts all at once. Besides optimizing the technique for production, the scientists want to develop a second version whose injection channel dissolves over time, reducing the implant's size even further.

    Boeing halts 787 deliveries until batteries fixed

    Boeing Co. is stopping deliveries of the 787 until the plane's electrical system is fixed.

    Boeing says production is not stopping. The plane is assembled in Everett, Wash., and North Charleston, S.C. out of pieces built all over the world.

    The Federal Aviation Administration has grounded the 787s currently in use until Boeing can prove the batteries are safe.

    The FAA's emergency airworthiness directive issued late Wednesday said the 787's battery system would need to be modified, "or other actions" taken, under a method approved by the FAA. However, the agency has not said what those actions should be.

    Boeing said deliveries are stopped until an FAA-approved fix has been carried out. The FAA has said it is working on a fix but it has not said how long it will take.

    Boeing's move is not surprising. Many experts had suspected that airlines would not accept new 787s from the company until the FAA directive was carried out.

    Boeing hasn't delivered a 787 since one went to Air India in early January, before a battery fire raised concerns about the plane's safety. Boeing has said no other deliveries were planned during that time.

    A lithium ion battery caught fire on a parked Japan Airlines 787 on Jan. 7. That fire prompted federal investigations, including a potentially broad FAA look at the plane's electrical design and manufacturing.

    This week the battery on an All Nippon Airways 787 overheated in flight, prompting an emergency landing. That caused the Japanese airlines to voluntarily ground their planes, followed by the FAA order later the same day.

    Boeing shares fell 22 cents to close at $75.04 before the delivery announcement was made. They dropped another 14 cents in after-market trading.

    Israel?s Jihad is Also Mine

    by Qanta Ahmed. As Israel considers building a new fence to contain the Syrian conflict to the north, which fences can keep out Hamas?s even more lethal ideologies? While Gaza and the Muslim Arab world continue to claim victory in the recent Israel-Hamas conflict, for the sane observers among us, there is only ever defeat ? the defeat of morality in the desecration of a great religion. While most Muslims laud Hamas and scorn Israel, for me, an observing Muslim, Israel?s war against Hamas remains my struggle ? my jihad.

    ?

    Israel?s eight-day operation ?Pillar of Defense? sought to dismantle the Hamas apparatus from within Gaza. The predictably seamless alignment of the Muslim world against Israel was even more breathtaking than usual in the face of Syria?s 22 months of systematic genocide, one which has consistently failed to trigger unanimous Muslim protest. What does this say about us as Muslims?

    We are hypocrites.

    While Muslims define Israel as the enemy, we ignore Assad, and diabolically laud Hamas. Hamas is never sated ? each year it devours ever more Palestinians, regardless of age or gender. If Israelis lose fewer citizens than the Palestinians in these conflicts it is for the same reason Israel exchanges more prisoners for each captive soldier: quite simply Israel values human life more than does Hamas, which relishes ground operations taking place among densely populate civilian areas.

    Explaining this to Muslims in the Twitterverse, I get sharply reminded that Hamas does not have the ?luxury of launch sites? that Israel enjoys. Have we lost our minds, Muslims? How can we speak of ?launch sites? as ?luxuries? while disregarding the culling taking place in Syria? Perhaps we have not lost our minds, but we have most certainly lost our religion.

    As I am not one to speak for others, allow me to let Hamas speak for themselves. They are bald-faced about their mission, seeking glory through death, annunciation through annihilation:

    We are ready to offer 1,000, 2,000 or even 10,000 martyrs every year. We are ready to keep offering martyrs for twenty years because we are sure we are moving in the right direction and that we will prevail in the end? (Hamas leader Khalid Al Mish?al in Gaza?

    To Hamas, a Palestinian life is worth more when ?martyred,? a dead child more of a blessing than one living. ?The children of the kindergarten are the shaheeds [martyrs] of tomorrow,? reads a sign displayed at a Hamas-run kindergarten. The martyrdom mantra is their anthem.

    While observers speculate Hamas will shortly usurp the crumbling Fatah leadership and ideologically annex the West Bank, we must remember Hamas? raison d?etre: Islamist nihilism, a totalitarian ideology, jet-fueled on the language and images stolen from mighty Islam. Israeli negotiators who must engage with this opponent are walking on the sharp-edged sword of Damocles and unlike Muslims, the Israelis certainly know it.

    Coloring their fascism with Islam, Hamas claims religious legitimacy to openly seek destruction of the Jewish state and eradication of the Jewish people. By grafting themselves onto Into Islamic ideals ? the vertebral column of that which is most sacred to Muslims ? they render Islam itself heinous, representing their true ruthlessness: theirs is a willingness to sacrifice anything ?including Islam ? to portray Israel as evil.

    This ethos was captured in a single unprecedented obscenity: Hamas? morbid motorcade. Cocksure thugs, defiantly cruising on motorcycles trailed exposed cadavers of Palestinians ? Muslim men ? trousers pooled at dead ankles. To chants of ?Allah-hu-Akbar? as dozens of Palestinian onlookers silently watched, Hamas took its ghoulish victory lap explicitly to show Gazans how they execute ?suspected informers to Israel?. This is the Islam of Hamas.

    This is why Hamas does not represent me, or other believing Muslims. This is why Israel?s battle is mine. This is why Israel?s struggle ? Israel?s jihad ? is mine. These are the ?Muslims? that Israelis must confront and these are the ?Muslims? who intimidate innocent Palestinians into subjugation to their monstrous political Islamism.

    But we Muslims in particular, more than conflict-hardened Israelis, should hardly be surprised, for it was Muslims who were once forewarned of scourges such as Hamas.

    The Prophet Mohammed (SAW) was once asked what he most feared for his followers. Centuries later, his response, recorded in the hadith, haunts, stating he feared those who:

    ?Interpret verses of the Qur?an out of context?A people that recite Qur?an?.but it will not go past their throats, a people with excellent words and vile deeds. They will pass through the religion (of Islam) like the arrow passes through its quarry. They will no more come back to the religion than the arrow will come back to its course. They are the worst of human beings and the worst of all creation. They summon to the book of Allah, but they have nothing to do with it. Whoever kills them is closer to Allah than they.

    This is the true nature of Hamas, which recites the Quran yet doesn?t hold it in their hearts, that ?summon to the book of Allah but have nothing to do with it.? By the above, it would seem the IDF (that eliminates Hamas) is surely closer to Allah than Hamas.

    Yet instead of condemning Hamas, and recognizing them as imposters among us, the Muslim world celebrates them, even as Hamas violates the most profound Islamic principle: the sanctity of life, a right man must protect even in preference to any rights God claims from man.

    When Muslims support Hamas, we support no less than the signatories to Islam?s collective extinction. Muslim support renders Hamas legitimate, their methods acceptable, their ideals valid. Our support as Muslims is their lifeblood. In supporting them, we hemorrhage our only currency, our only asset ? our great monotheism.

    Two years into the Arab Awakening, the freshly turned soil is ripe for the seeding. Hamas operatives everywhere are already celebrated as ?liberators? of Gazans, when they have actually long been their jailers, ?victors? over Israel, when Hamas is the personal death knell of all pluralism in the region. Gazans so recently celebrating in the street are no more than hostages afflicted with the worst Stockholm Syndrome imaginable, heading to their own death through their misplaced hope in their virulently Islamist leadership.

    During Operation Pillar of Defense, Jewish friends said ?this must be such a difficult time for you, but I am glad of our friendship? implying that because I am Muslim, my loyalty must surely be to Gaza, my enmity automatically aligned with Israel.

    Not so. As a Muslim, I am clear: my loyalty is with Islam, and therefore explicitly with justice, justice for all humanity, a humanity that must include Jews. Hamas is obscenely unjust, so how can my loyalty be with them? To be loyal to Hamas is no less than to abandon Islam. To be loyal to Hamas is the ultimate blasphemy.

    While I understand the need for Israeli negotiators to engage with Hamas first to secure the current ceasefire and then for some sort of functional peace, the reality is their militant ideology must be suffocated out of existence or else the d?tente is little more than an illusion. For this, unlike for suicide bombers or Syrian rockets, there are no Israeli fences or walls, no Iron Domes, only Muslim barriers ? robust barriers of counter-ideology.

    It is Muslims who must take the first steps to excoriate Hamas, to expose them as the ruthless nihilists they explicitly announce themselves to be. We must scorn Hamas for masquerading among the poor as their savior when they are instead their executioner. Muslims must hold all media accountable for telling the truth: Palestinians are the Muslims orphaned not by Israel but by the entire Muslim world itself. Land-grabs and permanent refugee camps are testament to such.

    We must ask ourselves the difficult questions. Does Hamas, who prostitute their progeny in the service of terror, represent Islam? Is Hamas emulating our Prophet as they rain rockets on unarmed, civilian, non-combatants? Do their Fajr missiles, named after Muslim prayers no less, encompass the spirit of Islam as was revealed to its followers? Do Hamas? stated goals ? including elimination of Israel ? represent coexistence with the People of the Book, who are cherished in the Quran as dear to God and their Messenger, Moses, particularly admired by our Maker for his courage in the face of fear?

    Don?t be fooled by Hamas? words Muslims; we have a duty to judge them on their vile deeds.

    If Islam is to truly thrive, it will only do so when more and more anti-Islamist Muslims confront and extinguish radical Islamist ideologues. Otherwise, we stand to lose both Israel and Islam in one fell swoop of the Islamist axe. Whether rescuing Palestinians and Israelis captive to the whim of Hamas, or rescuing Islam from Islamist Hamas, this is truly our jihad and no one else?s, which is why Israel?s jihad is also mine.
